All parties with small claims cases before the Court are required to participate in mediation before their case will be placed on a calendar for a trial. Mediators are provided by the Court at no cost to parties. The Mediation Calendar is held via Zoom on the 2nd and 4th Fridays of each month. The Mediation Motions Calendar is every 1st Friday at 1PM.
Mediation is an informal and non-adversarial process for parties and/or their attorneys to discuss and hopefully resolve their dispute with the assistance of a mediator. The mediator, a neutral third-party, guides the discussion but has no authority to decide the case. Mediators do not provide legal or financial advice. If an agreement is reached, the agreement will be put in writing, signed by the parties and/or their attorneys, and submitted to the Court for review and approval. Once the agreement is approved and entered by the Court, the case will be closed. If no agreement is reached, the case will be placed on the next available calendar for a trial.
The mediators are students or graduates of John Marshall School of Law and are registered neutrals with the Georgia Office of Dispute Resolution.
You should immediately contact the Clerk’s Office to request an interpreter; the Court will arrange for an interpreter to assist you in the mediation at no cost to you.
No, but you can hire an attorney if you would like to be represented.
No, you do not have to reach an agreement, but the Court does require that you make a good faith effort to do so.
If a party does not do what they agreed to do, the other party or their attorney can file a motion (written request) asking the Court to enforce the agreement.
